EquiProperty Solutions – Terms and Conditions

1. Introduction

EquiProperty Solutions (“EPS”, “we”, “us”, or “our”) provides neutral property mediation and facilitation services to former spouses or parties involved in property transactions. By engaging our services or using our website, you (“Client”, “you”, or “your”) agree to be bound by these Terms and Conditions.

2. Services Provided

EPS provides facilitation and mediation services related to the negotiation, sale, purchase, or transfer of property between former spouses. Services include, but are not limited to:

  • Acting as a neutral Property Mediator;

  • Facilitating communication between parties;

  • Coordinating meetings and negotiations;

  • Providing guidance on offers, agreements, and documentation;

  • Liaising with legal, financial, and real estate professionals as requested.

Important: EPS does not provide legal, financial, or real estate advice, nor do we act as a lawyer, real estate agent, or advocate for either party. Clients are encouraged to seek independent professional advice where necessary.

3. Neutrality

EPS operates as a neutral third party. We do not favor, advise, or represent any party. All decisions, agreements, or outcomes remain the responsibility of the Clients.

4. Client Responsibilities

Clients agree to:

  • Provide accurate and complete information relevant to the property transaction;

  • Act in good faith and communicate openly;

  • Understand that EPS does not provide legal or financial advice;

  • Retain independent professionals (lawyers, accountants, real estate agents) as needed.

5. Confidentiality

EPS will treat all information shared during mediation as confidential. However, confidentiality does not extend to information required to be disclosed by law, court order, or regulatory obligation.

6. Fees and Payment

  • EPS fees are determined based on the scope of services agreed upon in advance.

  • Payment terms will be specified in the engagement agreement or invoice.

  • Late payments may incur additional charges.

7. Limitation of Liability

EPS is not responsible for any loss, damage, or dispute arising from property negotiations or agreements between parties. Clients acknowledge that EPS provides facilitation services only, and all final decisions, agreements, or outcomes are solely the responsibility of the Clients.

8. Indemnification

Clients agree to indemnify and hold harmless EPS and its representatives from any claims, losses, or damages arising from the Client’s use of EPS services, including any legal actions related to property disputes.

9. Termination

Either party may terminate the engagement with written notice. Termination does not absolve the Client of fees incurred for services already provided.

10. Governing Law

These Terms and Conditions are governed by and interpreted in accordance with the laws of the province or territory in which services are provided and the federal laws of Canada, as applicable.

11. Dispute Resolution

In the event of a dispute regarding EPS services, the parties agree to attempt resolution through mediation or alternative dispute resolution before pursuing formal legal action.

12. Amendments

EPS reserves the right to update or modify these Terms and Conditions at any time. Clients will be notified of material changes. Continued use of EPS services constitutes acceptance of the revised Terms.
